Montana Independent Contractor Exemption Certificate: A GC Review Guide
Montana ICECs address the individual contractor’s workers compensation status. A hiring company should check the named person, active credential and authorized occupation; an ICEC is different from construction contractor registration and from a workers compensation policy for employees.
What the official sources establish
- DLI describes an independent contractor as free from control in contract and fact and operating an independently established business.
- The current DLI program directs applications and renewals online and offers ICEC or self-elected workers compensation coverage routes.
- The current official application describes a two-year validity period. DLI guidance says the work performed must match the occupation listed on the certificate.
Match the credential to the actual work
A credential listing painting does not answer a request for demolition work. Record the planned services before checking the occupation field, then have the contractor resolve any mismatch with DLI. Also keep the liability certificate in the file: an ICEC addresses a different question from whether the business has general liability insurance. If an individual arrives with helpers, stop treating the earlier solo-owner review as complete. Ask which business employs the helpers and request evidence for their status.
A practical review workflow
- Obtain the individual’s name, credential number, occupation and project scope.
- Use the DLI contractor search linked from its program and retain the verification date and result.
- Match the activity on site with listed occupations; request separate status evidence for helpers or employees.
- Track the ICEC end date separately from liability-policy dates and recheck when scope or staffing changes.
Example: an insurance file that needs another check
A hypothetical painter supplies an active ICEC and a liability COI for an apartment repaint. Later, the same vendor offers to remove walls with two helpers. The manager should check whether the listed occupation matches the new work and who employs the helpers. Keeping the old painting credential on file without reviewing the changed scope would leave the central questions unanswered.
Keep the next review visible
Use the state requirements guide for the broader coverage context. Keep the supporting documents beside the subcontractor onboarding checklist, and use a COI review checklist for the policy fields. Record unresolved questions as pending review rather than treating missing evidence as confirmed coverage.

Frequently asked questions
Does an ICEC replace general liability insurance?
No. It addresses the individual’s workers compensation status. Request liability insurance evidence separately when your contract requires it.
What if the contractor brings helpers?
Review each worker’s status and the employing business. The individual ICEC should not be treated as coverage for everyone on site.
