What to Do When a Subcontractor Refuses to Provide Insurance

First determine whether the subcontractor is refusing to send documents, cannot obtain a required term, or believes an exemption applies. Those situations need different follow-up. Keep any work, payment or termination decision tied to the signed agreement and authorized reviewer.

State exactly what is missing

Send the requirement and the evidence you need. A general request for “your insurance” can miss the problem. Ask whether the vendor has an agent who can respond directly and whether a secure upload route would remove an administrative obstacle.

If the company claims it does not need workers comp, identify the state, business entity, owners, workforce and actual work arrangement. A tax form or contractor label does not resolve the relevant coverage rule. Start with the state requirements guide and official agency instructions.

Understand whether the term is available

Some requests need an endorsement, additional underwriting or a different policy. Others may be unsupported by the policy or inappropriate under applicable certificate rules. Ask the agent to identify the exact limitation rather than asking the subcontractor to change certificate wording.

Give the agent a usable document request, a response date and the reviewer’s contact details. Preserve the answer alongside the agreement.

A hypothetical response

A sole proprietor says workers comp is unnecessary because there are no employees. The GC records the state and owner status and asks for the appropriate official evidence. The vendor then discloses a hired helper. That fact changes the review; the initial statement cannot simply be accepted as a permanent exemption.

Escalate through the agreement

The authorized contract or risk owner should decide what the unresolved item means for mobilization. Follow notice, cure and approval provisions. Do not assume your business can withhold payment or terminate solely because a generic template says so. Obtain legal advice when rights or obligations are disputed.

Record an exception or unresolved issue

If a permitted exception is approved, use the exception form to record scope, conditions and expiry. If the gap remains, retain the open item and next action. The noncompliance notice can organize facts for review, but it does not create enforcement rights.

Frequently asked questions

Can I let a subcontractor start while documents are missing?

That decision belongs to the authorized reviewer under your contract and applicable rules. Record the unresolved evidence and any approved conditions.

Can a signed statement replace workers comp evidence?

Not universally. Exemption, exclusion and coverage documentation depend on the state and actual business arrangement.

Track every certificate automatically

Certy reads each ACORD 25, checks it against your requirements, and reminds vendors before expiry.
